About the Branch
The Compliance Branch provides specialist services to support efficient and effective compliance actions across all CER schemes. These services can include actions and activities that will help the CER to better understand who the participants are and to explain their behaviours so that we can provide targeted and timely guidance and outreach activities to enable them to meet their obligations. The branch also helps to detect non-compliance and to facilitate and enforce compliance within each scheme.

About the Section
The Compliance Branch has four sections:

The Compliance and Enforcement Section undertakes proactive and reactive compliance activities including investigations and developing and delivering compliance and engagement programs to prevent, detect and address serious non-compliance across schemes administered by the CER.
The Intelligence and Assessment Section provides a centralised intelligence function. The section produces intelligence reports to support scheme areas. It provides a preliminary assessment triage function for referrals of non-compliance. The section also maintains an ongoing participant monitoring function and coordination of engagement and collaboration with other regulatory agencies.
The Participant Assessment Section ensures that those who are applying to participate in the schemes administered by the CER meet fit and proper person checks which establish competency and capability benchmarks.
The Compliance Strategy and Assurance Section drives engagement on strategic compliance policy initiatives, reporting on compliance effectiveness and providing a centralised scheme audit and assurance function.
About the Roles
The agency is undergoing a period of significant change and growth, with new responsibilities and expanded scope of schemes, such as the Cheaper Home Batteries initiative. As a result, there are current and expected vacancies across all four sections in the branch.

APS Level 5 Investigators and APS Level 6 Senior Investigators
APS Level 5 Compliance Officers and APS Level 6 Senior Compliance Officers
APS Level 5 Intelligence Officers and APS Level 6 Senior Intelligence Officers
APS Level 5 Regulatory Officers and APS Level 6 Senior Regulatory Officers
When completing your application you will be asked to specify which role/s you wish to be considered for. The core duties and requirements for each role are outlined below.

Investigators and Senior Investigators
Under limited direction, the APS Level 5 Investigator will:

Conduct routine investigations into suspected breaches of the law and aid Senior Investigators on more complex matters.
Assist in the preparation of briefs of evidence for criminal and civil proceedings, as well as reporting for administrative actions within agreed timeframes.
Produce accurate and timely advice and written materials for a range of internal and external audiences.
Provide coordination and secretariat support for the Operational Decision Group.
Identify opportunities to develop, implement and/or improve standard operating procedures.
Establish and maintain effective and productive relationships with CER staff and counterparts in other agencies.
Support the development of and participate in proactive regulatory activities including site visits and compliance monitoring activities.
Deliver outcomes consistent with the CER’s Compliance, Education and Enforcement policy.
Maintain records and be proficient in the use of the COMtrac case management system.
Duties of the APS Level 6 Senior Investigator will include, in addition to the above:

Undertaking a leadership role in the section through the coaching of junior staff, the identification of goals and organising team initiatives, as well as leading the development, implementation and/or improvement of standard operating procedures.
Conducting complex investigations, preparing and presenting briefs of evidence for criminal and civil proceedings, and reports for administrative actions under minimal supervision.
Interpreting and applying legislation, regulations and policies to determine the correct course of action.
Producing accurate and timely advice for a range of internal and external audiences.
Developing and leading proactive regulatory activities including site visits and compliance monitoring activities.
Qualifications and Experience
For the APS Level 5 Investigator roles, a Certificate IV in Government Investigations would be highly regarded.

For the APS Level 6 Senior Investigator roles, a Certificate IV in Government Investigations, or a willingness to obtain, is required. Previous experience in compliance-based roles will be highly regarded.

Compliance Officers and Senior Compliance Officers
Under limited direction, the APS Level 5 Compliance Officer will:

Work as part of a multidisciplinary team responsible for recording, triaging and assessing allegations of non-compliance in the schemes the agency administers.
Conduct preliminary assessments of referrals, including those of a moderately complex to complex nature, to determine whether suspected breaches of agency-administered legislation or other relevant legislation have occurred.
Prepare critical decision briefs and present matters to the Operational Decision Group, providing recommendations on how allegations of non-compliance may be addressed.
Prepare reports for administrative purposes and undertake other administrative tasks as required.
Provide sound advice on triage matters pertinent to agency-administered schemes, which influence the decisions made by others.
Manage projects relevant to the proactive monitoring of non-compliance in the agency’s schemes.
Establish and maintain effective working relationships with agency staff and counterparts in other agencies.
Develop and maintain technical expertise in the agency systems and data holdings.
Maintain accurate records in line with agency requirements and proactively undertake records management tasks and projects.
Duties of the APS Level 6 Compliance Officer will include, in addition to the above:

Conduct preliminary assessments of complex and sensitive matters.
Undertaking a leadership role in the section through the coaching of junior staff, the identification of goals and organising team initiatives, as well as leading the development, implementation and/or improvement of standard operating procedures.
Manage projects relevant to the proactive monitoring of non-compliance in the schemes administered by the agency and deliver outcomes in line with agreed KPIs, providing guidance to less experienced members of the team to do the same.
Qualifications and Experience
For the APS Level 5 Compliance Officer roles, previous experience in a compliance, law enforcement or investigations role is highly regarded. Candidates should also have demonstrated experience in interpreting and applying legislation, regulations and policies to determine appropriate courses of action.

For the APS Level 6 Senior Compliance Officer roles, in addition to the above, previous experience in leading small teams and mentoring is required.

Intelligence Officers and Senior Intelligence Officers
Under limited direction, the APS Level 5 Intelligence Officer will:

Perform research and analysis involving moderately complex to complex issues, using multiple information sources to inform regulatory decision making and protect the integrity of agency schemes.
Prepare intelligence reports, briefing material and communicate findings to inform agency compliance or enforcement activities and risk management.
Develop and support relationships with internal and external stakeholders and respond to stakeholder needs and expectations.
Develop and maintain skills with the expectation to work across multiple functions of the team as required.
Maintain an understanding of relevant legislation, policy frameworks and operational procedures.
Maintain technical expertise in agency systems and data holdings and contribute to business and process improvements.
Duties of the APS Level 6 Senior Intelligence Officer will include, in addition to the above:

Undertaking a leadership role in the section through the coaching of junior staff, the identification of goals and organising team initiatives, as well as leading the development, implementation and/or improvement of standard operating procedures.
Performing research and analysis involving complex or escalated issues.
Preparing and reviewing intelligence reports, briefing material and communicating findings to inform agency compliance or enforcement activities and risk management.
Developing and maintaining complex relationships with internal and external stakeholders and responding to changing needs and expectations.
Qualifications and Experience
For the APS Level 5 Intelligence Officer roles, experience using large databases and a Certificate IV in Government Investigations would be highly regarded.

For the APS Level 6 Senior Intelligence Officer roles, tertiary qualifications in a research, intelligence or government discipline would be highly regarded, as will practical experience undertaking intelligence analysis.

Regulatory Officers and Senior Regulatory Officers
Regulatory Officer duties will vary based on the specific section and these are outlined separately below.

Under limited direction, the APS Level 5 Regulatory Officer will:

Participant Assessment Section

Undertake assessment of applications for entry into our schemes, assisting with the authentication of identity documents.
Draft executive briefs supporting the assessment of applications for entry into our schemes.
Contribute to the maintenance and development of section standard operating procedures.
Interpret and apply legislation, regulations and policies to determine appropriate courses of action.
Prepare requests for information, notes and relevant correspondence for processing applications.
Engage with a variety of internal and external stakeholders about technical issues and legislative obligations.
Compliance Strategy and Assurance Section

Contribute to compliance strategy and regulatory activities by working across teams to analyse complex issues, providing advice and overseeing aspects of greenhouse and energy audit regulation and interpretation.
Assist with development of external communication such as the annual compliance and enforcement priorities and quarterly compliance updates.
Coordinate outreach activities such as auditor annual workshops, webinars and web publishing updates.
Prepare draft reports and briefs to senior management and agency committees.
Collaborate and consult with other teams to identify priorities and think strategically to research, investigate and analyse complex issues.
Duties of an APS Level 6 Senior Regulatory Officer will also include, in addition to the above:

Overall management of the participant assessment process for scheme entry and registration.
Make decisions using good judgement, expertise and knowledge.
Manage relationships with internal and external stakeholders, including supporting through changes to CER systems.
Undertaking a leadership role in the section through the management and coaching of junior staff, including work allocation and day-to-day supervision, the identification of goals and organising team initiatives, as well as leading the development, implementation and/or improvement of standard operating procedures.
Analysing compliance, audit and inspection data and preparing associated reports.
Oversight of data quality within SharePoint and CRM.
Program management within the section, including the compliance initiative, the agency’s audit program, management of auditors, auditor inspection program and stakeholder engagement and education programs.
Qualifications and Experience
For the APS Level 5 Regulatory Officer roles, experience working with standard operating procedures to defined timeframes and schedules is required. Experience interpreting and applying legislation is highly regarded, as is experience using a Customer Relationship Management (CRM) system.

For the APS Level 6 Senior Regulatory Officer roles, experience working in a regulatory environment is required, as is the ability to distil complex information and identify critical issues. Experience working in a high-volume area with defined timeframes, as well as team leadership experience, will be highly regarded.
