General Manager - Non-Litigation (Real Estate Industry)
The ideal candidate will possess a strong legal background with expertise in business development, property acquisition, contract negotiation, legal documentation, regulatory compliance, and dispute resolution within the real estate sector.
Key Responsibilities:
• Business Development Property Acquisition: Lead negotiations, prepare term sheets, and structure transactional documents in collaboration with business development and technical teams. Conduct extensive legal due diligence, including title investigations, for properties under consideration for acquisition.
• Legal Documentation: Structure and draft a wide range of legal contracts and transactional documents, including but not limited to term sheets, LOIs, MOUs, sale agreements, joint development agreements, and conveyances. Review, negotiate, and finalize major contracts and legal documents required by operational departments.
• Regulatory Compliance: Ensure compliance with Real Estate Regulatory Authority (RERA) regulations. Handle RERA complaints, queries, and regulatory filings.
• Litigation Management (may be required): Oversee litigation across various courts, tribunals, and authorities, including preparation for trials, arbitration, and mediation. Manage litigation management information system (MIS) and statutory audits for the legal department.
• Legal Support and Advisory: Provide legal support and documentation for project finance and marketing activities. Offer legal assistance in the preparation of opinions, studies, reports, and correspondence as required by internal departments.
• Vendor Management and Operational Support: Advise on vendor issues and provide legal support to project heads, corporate heads (Finance, HR, Liasoning, etc.), and operational teams. Respond to customer queries, legal notices, and correspondences with societies and government authorities.
• Team Supervision and Development: Supervise legal research and analysis, monitor the performance of panel lawyers, and provide advice on forming new panels. Assign court cases to panel lawyers, monitor case progress, and ensure effective interaction with legal officers and courts.Qualifications:
• Bachelor's degree in Law (LLB) required; Master's degree in Law (LLM) preferred.
• Extensive experience in non-litigation legal roles within the real estate industry.
• In-depth knowledge of real estate laws, regulations, and industry practices.
• Strong negotiation, drafting, and analytical skills.
• Excellent communication, leadership, and team management abilities.
• Proven track record of effectively managing legal risks and resolving complex legal issues.
