Job Description
Background of the role
We are looking at hiring an experienced and high caliber individual to join the India Compliance team based in the Mumbai office. This team provides compliance coverage to all of the Firm’s businesses based in India. This team works very closely with the regional compliance team based in Hong Kong and Singapore.
The candidate will be supporting the Sales and Trading businesses across two Business Units (BU), viz. Fixed Income Division (FID) and Institutional Equities Division (IED), with greater involvement in FID Compliance related matters. The candidate will report to the Head of India Compliance.
FID – MS FID has RBI-licensed Primary Dealer (PD). The main activities of the PD include trading in Indian Government Securities (in the primary and secondary market), Corporate Bonds, dealing in Currency Derivatives, Interest Rate Derivatives, Pass Through Certificates, etc. The PD also has plans of diversifying its activities into certain permitted allied activities. The PD has received an Authorised Dealer / Authorised Person license (FX License) from RBI to deal in foreign exchange products. The candidate is expected to manage the day-to-day functioning of the FID compliance coverage, which includes advising on RBI related matters, reviewing and implementing new / existing regulatory guidelines (e.g. Scale Based Regulations for NBFCs/PDs and other applicable guidelines for PDs), acting as a primary contact person for RBI and other regulatory authorities, managing RBI’s inspections and periodic data requests, managing other regulatory / internal audits, providing solutions for complex business proposals and/or regulatory issues, taking a lead in setting up the domestic foreign exchange business (FX License implementation). The candidate will also be working closely with the regional compliance teams based in Hong Kong and Singapore.
IED – MS IED is one of the top tier Institutional stock-brokers in India. MS IED is also setting up operations in the GIFT City in Gandhinagar, Gujarat in the form of an investment vehicle. The candidate will be providing compliance support to the IED BU which includes advising on SEBI and stock exchange related matters, liaising with regulators, leading inspections and audits, providing solutions for complex regulatory issues, reviewing and implementing new / existing regulatory guidelines, advising on client documentation etc. The candidate will also be working with regional compliance team based in Hong Kong and Singapore in providing advice to MS Foreign Portfolio Investors.
Duties will also include:
Identifying and advising the BUs on new or changes to existing laws, regulations and anticipated areas of regulatory focus.
Participating in various projects, such as new product initiatives and implementation of new regulations.
Supporting new business / technology initiatives, like implementation of new trading and booking systems.
Advising and supporting the BUs on a wide range of internal and trade-related compliance matters.
Drafting policies and procedures, including written supervisory procedures
Reviewing existing processes, controls, policies, etc. and recommending enhancements in light of change in regulatory environment and other internal / external events.
Designing training materials and conducting training sessions.
Providing guidance and working closely with the Legal / Litigation / Surveillance / Regulatory Inquiries / Other relevant teams in connection with the preparation and response to regulatory inquiries and examinations related to Sales and Trading activities.
Participating in industry forums, reviewing and implementing best industry-practices
Liaising with regional and global Legal and Compliance colleagues on matters pertaining to Sales and Trading matters.
QUALIFICATIONS
Skills required (essential)
A Qualified Chartered Accountant or Corporate Secretary (a Law Degree preferable, but not necessary).
8 to 12 years of working experience in Compliance function of a reputed Bank or a Financial Institution.
Should be able to independently handle the Sales &Trading compliance function.
Strong personality, experienced in dealing with senior business unit colleagues.
Solid understanding of the nuances of the local fixed income markets and capital markets
Experience of dealing and lobbying with regulators and managing regulatory inspections.
Experience of domestic foreign exchange business (FX License) related compliances.
Experience of working in collaboration with offshore compliance counterparts.
Detail oriented, motivated and able to multi-task in a fast paced environment.
Exceptional written and oral communication skills required.
